About these terms
These terms apply to all services provided by Spark Automations, operated by Dan Kerfoot, Nottinghamshire, UK. By booking a discovery audit or commissioning a build, you agree to these terms.
Discovery Audit
The discovery audit fee is £250, paid in full at the time of booking. This fee is non-refundable if you cancel within 24 hours of the scheduled call. Outside of 24 hours, we will rebook your slot at no charge. If you go ahead with a build, the £250 is deducted from your build price.
If Spark Automations needs to cancel or reschedule a booked audit for any reason, we will offer an alternative slot or a full refund of the £250.
Build Projects
All build fees are paid in full before work begins. A fixed price is agreed in writing before any build starts. Any changes to the agreed scope requested by the client after work has begun will be scoped and priced separately.
What we guarantee
Any faults with our build caused by our own work will be fixed at no charge. Breaks caused by third-party tool updates, API changes or platform changes outside our control are covered under the monthly retainer. For clients without a retainer, these are chargeable at our standard rate.
Retainer
The monthly retainer covers monitoring, fault fixing and up to three client-requested changes per month. Additional changes beyond three are quoted separately. The retainer is billed monthly and requires 30 days written notice to cancel, which can be given at any time after the first three months.
Regulatory compliance
Spark Automations does not provide financial, legal or compliance advice. Any automation of client communications remains the client’s responsibility to review for regulatory compliance with their relevant professional bodies and applicable law.
Intellectual property
All automation builds, workflows and documentation produced by Spark Automations for the client remain the client’s property once payment is received in full.
Disputes
In the event of a dispute, both parties agree to attempt resolution by email before pursuing any formal proceedings. Contact dan@sparkautomations.co.uk in the first instance.
Liability
Spark Automations is not liable for loss of revenue, data or business arising from automation failures, third-party platform outages or changes outside our control. Our total liability in any circumstance is limited to the fees paid in the preceding three months.
Governing law
These terms are governed by the laws of England and Wales.
